Sec. 498A is being misused by women to lodge false complaints against husbands and their relatives says Supreme Court.

Times of India reports:

NEW DELHI: The Supreme Court has plainly told the government to take a relook at the anti-dowry law — Section 498A of Indian Penal Code — saying it has been misused by women to lodge false or exaggerated complaints against husbands and their relatives accusing them of cruel behaviour.

Such is the level of exaggeration of cruel behaviour on the part of husbands and their relatives that “to find out the truth is a Herculean task in a majority of these complaints”, said a bench comprising Justices Dalveer Bhandari and K S Radhakrishnan.

Expressing concern at the rise in number of complaints under Section 498A, the Bench said, “We come across a large number of such complaints which are not even bona fide and are filed with oblique motives.”

Advising extreme caution in dealing with such complaints, the bench said courts must take pragmatic realities into consideration while dealing with matrimonial cases.

It was high time that the legislature considered and made suitable changes in the law taking into account public opinion, the apex court said, sending a copy of the judgment to the Union law minister to initiate the process.

“At times, even after conclusion of criminal trial, it is difficult to ascertain the truth,” it said and gave examples of cases where the woman in her complaint had roped in the husband’s relatives, who lived in different cities and rarely visited them, of cruel behaviour towards her.

Such accusations invariably led to the husband and his relatives remaining in jail for a few days, breeding rancour, acrimony and bitterness and ruining all chances of an amicable settlement, said Justice Bhandari, writing the judgment for the bench.

The significance of the court’s directive goes beyond what happens to Section 498A. It marks a conceptual shift, a turn away from the culture where women were seen only as victims who were incapable of levelling false allegations. The conception of women as the silent suffering sort who could do no wrong has influenced the administration of justice in both open and subtle ways. The assumption of women’s innocence is apparent in laws devised to deal with rape and other crimes against women where the presumption of innocence is not available to the accused.

Section 498A and other laws were meant to level the field which has traditionally been tilted in favour of men, and were meant to help women get their due. But with instances of their misuse rising, the apex court has been impelled to draw the government’s attention to revisit the issue.

“It is also a matter of common knowledge that exaggerated versions of incidents are reflected in a large number of complaints. The tendency of over implication is also reflected in a very large number of cases,” he said.

“Criminal trials lead to immense suffering for all concerned. Even ultimate acquittal in the trial may not be able to wipe out the deep scars of ignominy,” the bench said.

“The Hindu” reports from Salem:

SALEM: A national-level coordination forum of men has called for protection from wives and live-in partners whom they charged with exploiting women’s welfare legislation that arm them with ‘unbridled’ power to act against men.

The men, who claim to be ‘victims’ of such legislation from all over the country, spent three days in a resort at the hill station of Yercaud near here to deliberate on how to protect themselves and their kith and kin from harassment and to kick-start a campaign to impress upon policy-makers to think about their plight before enacting such lop-sided laws.

The forum said that many women were abusing these laws for nefarious gains by filing charges against their husbands and partners.

The provisions in these statutes, they called, were ‘anti-men’ leading to suicide of nearly 60,000 men as against 32,000 women annually.

Between 2004 and 2008, seven lakh men and family members were arrested including 500 minors and 5000 aged people, they claimed.

They pointed out that, for instance, laws such as the Dowry Prohibition Act, Protection of Women from Domestic Violence Act, Sec 125 of Cr. PC and above all Section 498A of Indian Penal Code were too stringent and non-bailable.

Women’s lobbies

“Though a debate is going on in legal circles on whether to amend or not especially Sec 498A to prevent its abuse, a few powerful women’s lobbies are blocking it,” said Suresh Ram, National Collegium member, All India Men’s Welfare Association, which organised the 3rd Men’s Rights Conference of the Delhi-based Save Indian Family Foundation at Yercaud in Salem district.

Delegates from Maharashtra, Assam, West Bengal, Uttar Pradesh, Karnataka, Andhra Pradesh, Chattisgarh, Madhya Pradesh and from the U.S. attended the deliberations.

A majority of them were from Karnataka, mainly young Information Technology professionals. They said that they would urge the government to replace the words ‘Husband and Wife’ with ‘Person’ in the said acts. They said that cases before Family Courts should be expedited and settled within two years.

The government would be approached to form National Commission for Men, they add.

Thanks: The Hindu

AS women clamour for equality, some men are also gearing up to fight for their rights. And what they too want , is equality.

“There are 24 laws that are women-centric in our system,” says Frances Anthony, convenor of the Tamil Nadu Chapter of the All India Men’s Welfare Association (AIMWA).

“Women misuse the law and use their children to threaten the father. The laws are making ours a fatherless society,” he adds.
Just a week ahead of Father’s Day, this group of men proclaimed a national boycott of the Family Courts and submitted a memorandum and a petition to the Principal Judge of the Family Court, with an appeal to make the law gender-neutral.

Leading the group on Friday was Kalaiselvan, who has not seen his son for the last 12 years. “I got married in 1997 and filed for divorce in 2002.

Our son was born in 1999.

Though I have been given rights to visit and see my son by the court, I’ve not set eyes on my son since he was born
it’s been 12 years now,” he says. Kalaiselvan alleged that he lost his job as a civil engineer in Kuwait because his wife complained about him to the company . “She misused the judicial system, filed a dowry harassment case against me and I spent 25 days in jail without bail. Even now, she refuses to obey the courts. I have appealed to the court many times saying she must be booked for contempt for not allowing me to see my son, but the courts remain silent. The dowry harassment case is still on and I have no job and no hope of seeing my boy anytime soon,” he grieves. The men in this organisation say they were not against women or trying to deprive the fairer sex of their rights. “Women are not victims in all cases. In the 21st century, women are equal in their families. They have an equal voice.

But they’re misusing these laws and turning their husband into ATMs to withdraw money when they feel like it,” says Frances.

S Hariharan, an employee of a telecom firm, agrees and says, “I have not been given visitation and customary rights of my two children by the courts. It has been three
years since I last saw them.”

The solution, he says, is to play it carefully. “When we gave him the petition, the principal judge of the Family Court, Ramalingam, told us that the society needs to change. He agreed that laws are misused by women in many cases. He suggested that couples should go in for judicial separation until the child turns 18 after which they can file for divorce.
Judicial separation allows visitation rights for the father as well. Fathers too feel the pain when they’re separated from their children,” Hariharan says.

On 18 June 2010 – Friday before FATHERS’ DAY

Press Release

All India Men’s Welfare Association (AIMWA) is an organization formed to protect the Constitutional and Human Rights of men and boys. We fight against gender discrimination, legal terrorism and every other form of abuse suffered by men and boys.

AIMWA is organizing a Nationwide Boycott of the Family Courts on 18 June 2010 – the Friday before Fathers’ Day – as a sign of protest against the Family Court system which blatantly discriminates against fathers, heartlessly separates them from and prevents their access to their own biological children.

We concur with the recent observation of the Hon’ble Supreme Court of India that “the Hindu Marriage Act is breaking more families than uniting”. We would like to add that the worst sufferers of the Indian Family Court system are fathers and children.

Indian Family Courts have declared a war against fathers and are adopting every possible means to create a “Fatherless Society”. The modus operandi of the Family Courts includes:

Depriving fathers of the right to love and care for their biological children.

Forcing fathers to pay huge sums of money to support children they are not allowed to see.

Encouraging false allegations of abuse to paint fathers as unfit parents.

Permitting multiple legal battles by mothers to eliminate biological fathers from their children’s lives.

Passing ex-parte orders based solely on the allegations made by a child’s mother.

Allowing mothers to brazenly disobey visitation orders without legal repercussions to her.

Allowing biological fathers to be labelled “kidnappers” for trying to make contact with their own children.

Prolonging custody/visitation matters for years, thereby driving fathers into financial and emotional bankruptcy and forcing them to give up the desire to see their children.

It is time everyone recognizes that:

denying access to one’s own biological children is abuse of human rights.

depriving children of the love and care of their biological father is abuse of children’s rights.

AIMWA hereby registers its vehement protest against the separation of fathers from their biological children, and the concomitant violation of Human Rights perpetrated by the Family Court system against fathers and children.

AIMWA shall continue to agitate against the Family Court system until the following demands are met:

Special fast-track courts should be set up at the earliest to deal with custody issues.

Exclusive, fully functioning Divisional Bench should be set up in all High Courts and Supreme Court to hear appeals in matters of child custody.

When a person or couple approaches court for divorce, counseling of the parents by professional counselors should be given first priority.

Except in extreme cases of violence or unhealthy behavior by either partner, children should be given equal and meaningful access to both parents and grandparents on both sides.

Both parents should be given financial responsibility of the child proportionate to their earnings and not based on demands made by either partner.

If a partner prevents a child from having equal and meaningful contact with the other partner, they should be counseled first to understand the importance of equal parenting and the best interest of a child.

If either partner repeatedly disobeys orders of equal access and meaningful contact with children, then the children should be placed in the full custody of the partner who will allow equal access to the other parent.

Boycott Family Courts!

AIMWA hereby calls upon all fathers to:

Join our Nationwide Boycott of Family Courts on 18 June 2010 as a symbol of protest against the creation of a fatherless society!

Sign our Petition listing out the changes we demand from the Family Court system in child custody matters!

Refuse to pay maintenance and child support unless the aforementioned demands are met!

Settle for nothing less than free and fair access to their children and an equal opportunity to build a meaningful relationship with their children!

Doublespeak is their forte!

The Honorable Indian Minister for Home affairs was asked the below questions on abuse of the dowry law in parliament. Before we even go into the questions and the home minister’s answer, we need to know and bear in mind that the home minister as well as his wife are both very learned and eminent lawyers and understand the Intricacies of marital and dowry laws better than anyone else. Incidentally the home minister’s wife was also involved in the High profile 498a case of Tamil Actor Prashant in 2007 (against the husband, of course!).

As is his wont (and that of every glib-tongued lawyer and feminist) the home minister plays the tried and tested trick of confusing dowry harassment law ( section 498a) with dowry death ( section 304B) – call it a red herring, if you prefer!

Below is the extract of the conversation from the resources available with the Lok sabha:-

Fifteenth Series, Vol. VIII, Fourth Session, 2010/1931 (Saka)
No. 15, Tuesday, March 16, 2010/ Phalguna 25, 1931 (Saka)
Page 10 , Date 16.03.2010

SHRI PRASANTA KUMAR MAJUMDAR :

Madam Speaker, every four minutes in India an innocent person, including the old parents and close relatives, is facing false dowry cases and sent behind the jail under Section 489-D which is non-bailable without any investigation and inquiry. No inquiry is required because the case is non-bailable. Only the statements of bridegroom’s family are taken into consideration.

MADAM SPEAKER: Please ask the question.

SHRI PRASANTA KUMAR MAJUMDAR : The Law Commission and many judges have recommended making the Section bailable but the Government did not do anything.

MADAM SPEAKER: Hon. Member please ask the question.

SHRI PRASANTA KUMAR MAJUMDAR : I want to know whether the Government has any proposal to make the case bailable or not. If it is bailable, please give details and if not, why?

SHRI P. CHIDAMBARAM:

I think I have already answered the question in part. I do not subscribe to the proposition that in most cases of dowry deaths, the provision is misused. That is not true. I gave you the numbers of cases that were registered in the last three years. Look at the number of people convicted. In 2006, 5144; in 2007, 5580 and in 2008, 5814 persons have been convicted. It may be true that in a few cases, indiscriminately, people may have been arrested and there may be some harassment but that is not true of the large number of cases. Therefore, we have advised the police that where a dowry death case is registered, they must exercise their discretion and arrest only those who appear in the investigation to be directly connected with the dowry deaths and not the extended family.

That advisory has been given. But I think on balance this provision is a salutary provision; a new offense has been created; people have to be punished when they kill young wives. If in a particular case there is an excess, there is a court system which will correct it. But to go, as I said, from one position to an extreme position and say there is massive misuse of this provision, Madam, with great respect, I beg to disagree.

Our comments:

Please see how the legally educated home minister dodges the question:

1) Section 498A and Section 304B are as different as chalk from cheese . 498A is the law that is invoked when a woman “claims” that she was harassed . This is the law that is most misused since it has got arrest on demand provisions and no investigations or evidence is needed .Looking at the severity of the misuse the supreme court of India has called the misuse of section 498a as “Legal Terrorism”. Section 304B is invoked when it is proved that a woman has been killed because to dowry .Section 304B requires a lot more evidence and proof and misuse is difficult since it is a life and death question. The honorable Lok Sabha member had clearly asked the Home Minister if section 498A needs to be amended due to its misuse and if not why ?

2) It does not take a legal degree to see that the Indian home minister very cleverly dodges the question on amending 498a and replies on why section 304B is must not be amended instead. He says ” I do not subscribe to the proposition that in most cases of dowry deaths(a.k.a section 304B, not 498A), the provision is misused. That is not true. I gave you the numbers of cases that were registered in the last three years. Look at the number of people convicted.”

Honorable home minister , why are you answering if 304B is being misused or not when the question clearly asks if 498A is being misused ?

The Home Minister the proceeds to state numbers for section 304B when the question asked was completely related to section 498A .

This is tried and tested trick that many feminists use when asked if 498a needs to be amended. They immediately switch the conversation from 498A to 304B and justify the existence of 498A because of a crime which comes under section 304B. , which is exactly what our lawyer Home Minister did here . For the nonlegal professional who does not understand the difference between section 498A and section 304B the answer of the Home Minister will sound totally credible .

3) Also notice that the Home Minister also quotes not the “number of convictions” under section 304B ( which is firstly irrelevant to begin with since question was on 498A ) but the “number of people” convicted under it. This was done since the number of cases and convictions under section 304B are too less to portray any serious threat of dowry death .Considering that single conviction results in 4 people getting jailed then the total number of conviction would be no more than 1500 .The Home Minister knows this and hence quotes the “number of people” getting convicted and not the number of “convictions”. Being an eminent lawyer himself he should have known better.

How committed the Indian government really is for eradicating dowry?

1) The central ministry for Women and Child Development has not spent a single Rupee on stopping dowry exchanges and extravagant marriages ,while Pakistan has started the one dish law to eradicate extravagant marriages in their country.

2) Instead of stopping dowry the government is openly encouraging dowry loans . State Banks create loans specifically for paying marriage expenses of women and paying dowry. The state bank of Hyderabad Kanya Vivah Suvidha Scheme is one such example of how Dowry loans are openly available from Government banks.

3) The Home Minister dodges questions on 498A abuse and gives a totally irrelevant answer related to section 304-B of IPC.

(Q. No. 261)
(HINDI Text)
THE MINISTER OF HOME AFFAIRS (SHRI P. CHIDAMBARAM):

Madam, Parliament makes the laws, but as everyone is aware, implementation of these laws is in the hands of the State Government and the State police. We have reviewed it and we have collected the data. That data is given in Annexure-I and Annexure-II, which is part of the answer. We have given information about cases registered, cases charge-sheeted, cases convicted, persons arrested, charge-sheeted and convicted, in Annexure-I and Annexure-II. These are reviewed in the Police Conferences that are held from time to time; they are also reviewed in the Regional Meetings from time to time.
But I wish to submit to this House that the implementation of laws especially criminal laws lies with the State Government and the State Police.

16.03.2010
(Hindi text)
10
SHRI P. CHIDAMBARAM:

Madam, my respectful submission is that it is not possible to make a sweeping statement that anti-dowry laws are being misused. Just look at the numbers. In the three years, 2006, 2007 and 2008 for which final figures are available, 7618, 8093 and 8172 cases under dowry deaths have been registered. These are appalling numbers. It is possible that in a handful of cases complaints have been made against a large number of people, there is some attempt to misuse these provisions. But one cannot say that in all these cases, the provisions have been misused.

We have, therefore, advised the police to act without bias, to register the case, investigate and arrest only those who appear in the investigation to be directly involved and not to arrest all and sundry. But I do not think we should go from one extreme to another and say, there is sweeping misuse of these provisions. There are large numbers of young brides, young wives being killed, and we must be sensitive to that fact, and we must take strong action whenever a dowry death is reported.

SHRI PRASANTA KUMAR MAJUMDAR :

Madam Speaker, every four minutes in India an innocent person, including the old parents and close relatives, is facing false dowry cases and sent behind the jail under Section 489D which is non-bailable without any investigation and inquiry.

16.03.2010
11

But I think on balance this provision is a salutary provision; a new offence has been created; people have to be punished when they kill young wives. If in a particular case there is an excess, there is a court system which will correct it. But to go, as I said, from one position to an extreme position and say there is massive misuse of this provision, Madam, with great respect, I beg to disagree.
SHRI MANISH TEWARI : Though this question may not strictly fall within the ambit of the Home Minister, since he is a very eminent lawyer, I think he will possibly be able to answer it. My question is that there are reports which have appeared in a section of the press that the Government is intending to amend the definition of rape to sexual assault in order to make it gender neutral. Is it a fact? Is the Government considering such a proposal? If that is so, what is the rationale behind this amendment?

My second part of the question is…

MADAM SPEAKER: You should just ask one question.

Men, who accuse their girl friends, wives and fiancees of duping them or foisting cases against them, have come together in Tamil Nadu to put up a collective fight.

According to the general secretary of Association for Protection of Men, Madhu Sudhanan, more than 1000 members are aged below 25 years and 4000 members are below 40.

At a meeting on Sunday, attended by over 50 men, there was a talk about rights and laws favouring women. But the association is not to protect men from the the misuse of the Domestic Violence Act and Dowry Harassment Act alone but also youngsters falsely accused of eve teasing.

As one man said: “I was dragged by the police and beaten up in the station. If a girl has a personal enmity, she takes it out by falsely accusing men of eve-teasing. And there is no verification done by the police when it comes to women, they just accept what she says as the sacred truth.” Another member of the association said that he was right now on the streets after he registered his family property in the name of his lover, who conveniently duped him after that.

Madhu Sudanan said that many young men were being cheated by girl friends – they emotionally ditch the man, by marrying men of their parents’ choice. But such cheating was never taken as a crime, he said. Most of the association members had been harassed by women – wives, girlfriends, fiancées – or duped.

But the system is biased towards women, Madhu Sudanan said, and added there are 84 laws for the protection of women’s rights, but none for men.

“Gone are the days when women were exploited. Now, many women misuse the laws meant for their protection. Many young men have been trapped by the laws.

Many youth ditched by girl friends are unnecessarily harassed by police following false complaints, another association member in his mid-30s, said.

… that’s what men’s organisations in the city are now looking to conduct

~ MANIGANDAN K R. Times News Network

Seeking to counter certain “exaggerated” claims made by some women’s organisations and in a bid to draw the attention of the government to the plight of men victimised by lop-sided laws drafted on the basis of such claims, men’s organisations in the city have now embarked upon the task of conducting a massive domestic violence survey.

The results of the nationwide survey, widely believed to be the first of its kind for men in the country, will be used to find out if whether Indian men too are victims of domestic violence, the percentage of Indian men subjected to such violence and the kind of violence they are subjected to.

The need for the survey has been triggered, it seems, by the controversial Domestic Violence Act – 2005, which seems to have been drafted on the assumption that only women suffer domestic violence.

Says Suresh Ram, member of the All India Men’s Welfare Association (AIMWA), an NGO working for the rights of men and boys, “Certain women’s organisations have been stereotyping the issue of domestic violence. They have presented a picture that conveys the impression that only women are victims of domestic violence while we have with us global surveys and over 250 scholarly studies that show that women are at least as likely as men to engage in partner aggression and that partner violence is often mutual. This fact is established if one goes through the Domestic Violence Study conducted by a well-known global organisation that has done the survey in over 32 countries including India. However, the Domestic Violence Act in India offers protection to only women and not men.”

He further adds, “So, to set things right, we men’s organisations have joined hands to ensure that a credible and transparent survey on the issue is done. Eight men’s organisations are involved in this effort which is being led by the AIMWA. We have begun negotiations with survey agencies to conduct the survey in certain cities of the country including Chennai, Delhi, Kolkata, Bangalore and Hyderabad. We intend to publish the results on Nov 19, the International Men’s Day.”

So, what do they intend to achieve by conducting such a survey? Says Suresh, “We intend to create an awareness in society about the problems faced by men. We wish to present to them the real situation in society. We will also seek to draw the government’s attention to issues concerning men and reiterate our demand for setting up a National Commission for Men and a Men’s Welfare Ministry.”

Men in the city are delighted with the move by the men’s organisations. Welcoming such a survey, Shankar, a graphics designer, says, “I certainly welcome the move. It is high time that facts were presented on this issue.”

Women too seem to be for such a survey. Says Dakshayini Sampath, a media professional, “While I think that more number of women suffer domestic violence, it’s also possible that men are victims. I think the law should hold good for both genders and if this survey is going to help bring about a uniform law, then I’m all for it.”

While feminists have always argued for concessions for women, often at the expense of men, citing skewed gender-ratio against girls and have been successful in getting them as well, but men at the same time have been facing tougher and tougher times.

Selective sex abortions and male-preference has been viciously twisted by feminists to unleash male-hatred and piggyback their sinister agenda onto it. As a result boys and men have to live a life without “FREEDOM of CHOICES” and they are forced to don the role of a PROTECTOR and a PROVIDER popularly known as the FREE ATM MACHINE and the UNPAID BODYGUARD.

At the same time, the most risky, menial and dangerous jobs are heaped on to men and the burden of responsibilities of maintaining the family – parents, siblings, wife, children, in-laws, etc. has also been thrust onto men leading to ever increasing and skyrocketing expectations from them and nose-diving acceptance levels for their shortcomings and weaknesses.

And it is because of this skewed balance of responsibilities between men and women, that the society prefers male children over female children. After all, everyone wants someone to take care of in the dusky days and why to have an offspring that cannot be imposed upon with responsibilities. It is not because of some over-flowing extra love for men that male children are preferred.

The situation can be very well explained in terms of economics. Because of preference and because of natural birth ratio of 950 females for every 1000 males, there is an over-supply of men and under-supply of women. As a result, obviously, women have become the prized asset enjoying aggravated levels of protection, pampering and concessions whilst men have become the surplus asset presumed to require no protection and something that can be disposed off with. This phenomenon, which is worldwide and irrelevant of culture or country, has led to the establishment of the Male Disposability as defined below,

Male Disposability is a psychological behavioral and attitudinal syndrome that considers Men as “Disposable and Expendable” and invests very low emotional resources with males which ultimately leads to an environment insensitive to the problems of the male world or one that automatically eliminates weak men (or men finished off with their utility) viewing them as liability,

An explanation of the above definition with statistics is also available at Male Disposability – Myth or Reality.

From a pure economical point of view, the dynamics between returns and risks is a direct function of the investments. Higher the investment, higher the returns and higher the risks involved as well. Big Corporate Houses have a lot of corpus fund to put into business, commerce and trade and as a result they make a lot of money as well but at the same time they do carry heavy risks and the needed potential to absorb huge losses as well.

Similarly since the society invests heavily in women (in terms of social, legal, emotional, economic and academic resources), the returns as well as the risks are extremely high. The returns are available in form of a very balanced and strong emotional health of women that gives many a positive results and the risks are in the form of extra precautions and laws needed for them and the negative results of strong emotional health of women and enhanced expression abilities.

Similarly, for men, as the investment is low (actually very close to zero), both the returns and risks are low. The low returns are manifested in the form of lack of expression from men, reduced capability of emotional confrontation, deformed and mutilated psycho-emotional health and low risks are obviously visible in the various instances of “Male Disposability” and expectation of high risk appetite from men.

However, society is facing a lot of problems. And each problem seems to stem from a string of such problems and also leads to multiple such strings and the whole situation looks like an entangled mesh of problems where each thread is stuck. And if things continue in this way, then it won’t be longer before societal structures crumble and societal power equations dissolve for all time to come with little or no scope of repair.

But as the old adage goes, “World lives on hope”, so is the case here. Still the choice lies with the society to “LIBERATE MEN from RESPONSIBILITIES”, increase its investment in men – socially, legally, emotionally, economically, and academically – and in turn get high returns.

However, one may argue that when things are running, what is the need to take higher risks? It is pertinent to mention here that things are definitely running, but where are they heading to? Are we to wait seeing things run to end? Or take a stand now and alter the future forever, because, nothing in life comes for free. THERE IS NO FREE LUNCH AVAILABLE. Everything comes associated with a price tag and many a times the price can be way costlier and precious than money or financial price; a loss that may not be recoverable at all if we do not prevent it now by LIBERATING MEN FROM RESPONSIBILITIES.

How will it help?

Liberating men from responsibilities and dissolving the freedom of choice of responsibilities across both the genders has many advantages.

First and foremost, it will provide men with the much needed space and time that they need for them to do something in life that interests them rather than just donning the humdrum role of a PROTECTING and PROVIDING male. This role often requires men to enter into a rat race and makes the male world extremely competitive, insensitive and violent and in such a case the possibility of the violence and aggression spilling over to other areas of life cannot be ruled out.

In other words, liberating men from responsibilities and giving them the freedom of choice will actually reduce the violent behavior of men to a large extent as opposed to the current style of punishing men. It is but obvious that the methodology is not working because rather than improving the lives of men and the society in general, it is reducing the quality of life. This is clearly evident from the enormously high stress levels in the life of men corroborated by an extremely high and exponentially growing suicide rate of men, reduced life expectancy and mostly men becoming victims of diseases like cardiac arrest, high blood pressure, diabetes – all of which are the direct consequence of abnormally high stress levels.

Lack of expressional capabilities, is a serious and known problem with men; a problem with which even the most renowned psychological counselors are grappling but unable to solve. Liberating men from responsibilities will give men the emotional space needed to develop expressional capabilities as they will move closer to their experiential domain. This will improve the life-quality of men in general and society at large. And this is something that needs to be implemented with our current generation of boys for they are the MEN of the FUTURE.

Liberating men from responsibilities will also mean giving an equal opportunity to women to take upon the same. This will be true empowerment of women as opposed to current and proposed ones which specifically target at punishing men – and it has already been shown above that it is not working.

Entrusting someone with responsibility is a true recognition of capabilities and an undisputed sign of empowerment. This will also lead to increased preference of female children and will solve the problem of gender ratio as well.

Hence, as we see, with a slight change in our attitudes and social perceptions of gender, we can solve some of the most difficult problems the current society is plagued with as opposed to the current way of formulating a new law for every social problem faced.

So do we agree to LIBERATE MEN FROM RESPONSIBILITIES?

Or is it that before striking any resonance do I need to ask the basic question – Do you even realize what Male Disposability is? If yes, then you probably know what’s going to be in the article. If no, read on to know it.

Male Disposability is a psychological behavioral and attitudinal syndrome that considers Men as “Disposable and Expendable” and invests very low emotional resources with males which ultimately leads to an environment insensitive to the problems of the male world or one that automatically eliminates weak men (or men finished off with their utility) viewing them as liability.

Since time immemorial, be it the life-endangering activity of hunting or saving the country-land or guarding the parameters of geographical boundary or maintaining law and order situation in the society – the latter two correlate to hunting human life – this role has always been attributed to men who have donned the same willingly boosted by their testosterone and chivalry. In a nutshell men have been hunters primarily and that is a defunct role in today’s era of pacification and intellectual progress.

However, the traits of history are hard to remove and the hunter’s traits have continued into today’s men as well who are actually a misfit in the society with their hunting background and their genetic and evolutionary affiliation to a hunting tribe. No wonders problems of men have skyrocketed and courtesy the Male Disposability Syndrome, no one is bothered about it.

Before talking more on Male Disposability, I would talk a bit on its genesis, taking cue from the article, Paradigm Shift in Male Identity: Freedom from Being a Hunter. During the hunting days, when men used to go on long hunting expeditions, any hunter talking of a minor leg pain or a slight backache was detrimental to the morale of the hunters and was silenced, trivializing his pain.

Even today the society has been pretty much the same for men. Earlier it was hunting, in today’s world its taking huge risks – financial, intellectual, emotional, physical, political – to name a few, that men are expected of and in such a situation, talking of small problems like an emotional turmoil in a relationship or facing lack of freedom of choices will bring down the morale of other risk-taking hunters and thus men are discouraged from expressing their pain.

This leads to a lot of psycho-emotional suffocation within men which has a direct bearing on their lifestyle, life-expectancy, health and suicide rate as visible from the following data collected from various sources of the Government.

Interestingly, in this so called MALE DOMINATED WORLD, the DOMINATED MALES never get a voice as corroborated by the following figures.

Life Expectancy Data:

Plotted as a Graph looks something like,

The data about suicides is also not very welcoming but a true and sad reality to which currently the society is insensitive and cold.

Plotted as a Graph, looks something like

The above data clearly points to the stress in men’s lives due to which they not only commit suicide in large numbers (approaching double that of women) but who survive the turmoil, live shorter. That being the reality, there is also another grim reality and that is

NO SOCIAL / LEGAL / PSYCHOLOGICAL SUPPORT STRUCTURE AVAILABLE FOR MEN.

Quintessentially the problems of the male world are oblivious to the society and as long as men are discharging their duties no one really needs to bother about them and can readily dispose them off, after all even Mother Nature produces them in abundance; what with the normal gender birth ratio being 950 females : 1000 males.

Choice is left with readers to decide whether Male Disposability is a Myth or a Reality?

DNA reports on the fallout of the ill-conceived Gillette campaign – “Shave India Movement, Women against Lazy Stubble”. AIMWA has lodged a protest with the Advertising Standards Council of India (ASCI) that the latest campaign by P & G “spreads hatred among genders” and “hurts religious sentiments.”

If Gillette chooses to term all Indians who grow beards as “lazy”, then their campaign denigrates the Indian Prime Minister Mr. Manmohan Singh who sports beard as per the custom of his religion, the Sikhism, as “lazy”. Is it not an affront to the honour of the whole nation?

Gillette owes a public apology for denigrating the high office of the Prime Minister of India.

Here is an excerpt from the report of DNA:

“In the Gillette campaign, men who do not shave or those who wear stubble are shown to be lazy, so their women have every right to detest and demean them,” said Mumbai-based PR Gokul of the All India Men’s Welfare Association (AIMWA). “Gillette also tags this campaign as women on the warpath. We feel it portrays men negatively and tries to curb their choices” said Mumbai-based PR Gokul of the All India Men’s Welfare Association.
Proctor and Gamble (P&G) claimed that the campaign was based on research findings. “Serving men since 1895, their well-being is at the heart of every decision that Gillette takes. In that spirit we respect all ideologies, communities and opinions that men have. WALS is a creative expression of research findings by AC Nielsen which state that a majority of women prefer their with a men clean shaven look. Our campaign is not an imposition of such views on men who feel differently or wish to grow facial hair out of choice. Our endeavour is to provide superior quality shaving products to men who wish to shave,” said P&G spokesperson.

“By calling men with stubble lazy, P&G have made a communal statement,” said Myth Kumar from Bangalore. Terming the campaign in bad taste, the Shahi Imam of Delhi’s Jama Masjid said, “Sikhs and Muslims wear beards due to religious reasons. But their wives do not complain. Companies should be careful of religious sentiments before running campaigns,” said Bukhari.
